Forklift Accident

QUESTION:

Whiplash from work accident? hello yesterday at work i was in a forktruck accident. I was unloading a truck that was docked. The dockplate failed and cause the forklift with me on it.. to drop about a foot at same time crashing so hard to a complete stop that its broke the rear axles
-wheel in the rear..i was sent to emergency room cause my head was hit really hard and my neck is stiff. The company i work for made me go to there dr today and said that i had cervical strain and is making me stay home till monday i have to go get a revaluation and see if i can go back to work. This is a accident due to a failing dockplate and it is causing me pain and 2 days of work plus whatever happends monday after seein him.. Should I sue my work for pain n suffering cause its not my fault i gotta suffer its not like horrible at moment but it is making me dizzy and bad headaches and my neck is really sore..I just dont wanna get fired if i decided to sue them but i think i deserve to get paid..they said it has to be 7 days off to i get workers comp for the day of my injury and they sent me to there dr this morning paying for it..but i was told unless im off 7 days none of my time will be paid for workers comp..im not like dying or anything but it really stiff and headaches..and im not sure if they got ahold of there lawyers yet cause i havent talked to any..and not sure if im hurt enough too..

ANSWER:

This is a workers comp claim. Unless you are an independent contractor. Workers comp will pay all your medical bills and time off work. If you are permanently disabled in any way you will receive a settlement also. If you are thinking about suing the company keep in mind that usually you will be asked to resign from your job as part of the settlement. Either way you may want to talk to a Workers comp attorney and they explain your options to you
